Jay’s Services
Pleas or Bench Trials
In most cases there is no need to go to a jury trial. There are still motions to be filed, conferences to be had with the prosecutors and the judge, and negotiations to get you in a better place from where you started at arraignment.
Jay will review all the evidence and get you to a plea deal you actually deserve based on what the government has on you and what the law says you actually deserve, not what the judge and prosecutor say you deserve.
Jury Trials
Prosecutors and judges often don’t obey the law or give regard to the facts. They want to believe the cops because the cops say you did it. If you did it, the case is over. That’s why statistics show over 90% of defendants who are underrepresented by attorneys are overpunished by the system.
Rather than be a statistic, sometimes a person needs to go all the way to a jury trial, convincing twelve everyday folks that you are either not guilty of what you are accused of or that you do not deserve the punishment the system thinks you deserve. That doesn’t always look like total exoneration or “walking away” like in the movies. Maybe you are innocent of some charges but not others. Maybe the punishment the prosecutor is insisting on and the punishment you will face from the judge is too harsh compared to what you deserve and what regular folks will give you instead.
A true arbiter of what is real, not a gaslight, are the tried and true twelve who don’t know each other who come in to do their duty to serve you as a defendant in the American justice system. Once in a while, you need them to step up and hand down what the prosecutor and the judge will not.
Rule 11.42 Overturning
of a Plea Deal, Bench or Jury Verdict
Most judges in Kentucky talk on record like they are auditioning for a daytime crime show. They say things like, “You pled guilty, so you must have done it.” This is the real world, though. Often, people are coerced by their attorney to plead guilty to things they didn’t do, or a jury or judge may have found them guilty even though the law says that is impossible.
Jay will take a look. To the extent he can’t help you, Jay doesn’t take your money.
